Government Enforcement & Investigations

Torridon advises and represents clients when allegations of wrongdoing risk government investigation and the potential for criminal liability or civil enforcement penalties.

Our lawyers have decades of experience in the regulatory and criminal enforcement arena and are exceptionally well positioned to help clients under investigation achieve a favorable outcome.

Our lawyers bring unique insight and know-how from extensive previous service as senior government enforcement officials. Our team includes a twice-serving US Attorney General, two State Attorneys General, three U.S. Attorneys, multiple veteran prosecutors and other lawyers from DOJ, the SEC, and other federal and state agencies, and the chief investigative counsels from four Congressional committees. Our two former White House Counsels and Deputy White House Counsels were responsible for defending against over a hundred Congressional investigations into Executive branch matters.

In private practice, our lawyers have had extensive experience representing clients in substantial investigations and enforcement matters – both at Torridon and at their previous major law firms or in their capacity as the top legal and compliance officers at major U.S. corporations.

Drawing on this deep expertise, Torridon attorneys advise and represent clients facing potential enforcement actions or investigations in several ways, including:

Compliance Advice: Even before allegations of wrongdoing arise, Torridon helps clients substantially mitigate risk. We understand the government’s evolving enforcement priorities and legal theories and are able to help clients frame effective and efficient compliance measures, allocating limited resources to mitigate the riskiest areas.

Internal Investigations: When allegations of wrongdoing surface—whether internally through the client’s own compliance efforts, or publicly from media, whistleblowers, or Congressional queries—Torridon can rapidly conduct an internal investigation so the client can quickly learn the facts and be in the best position to manage legal and reputational risk, and head off, if possible, a formal, government-led investigation. Torridon’s lawyers, collectively, have conducted or supervised scores of internal investigations both as outside counsel and as top legal and compliance officers in major corporations. The Torridon team is well-versed in the governance, confidentiality, and other sensitive issues that can arise in connection with internal investigations.

Enforcement Defense: When the government does pursue investigations, Torridon lawyers have the know-how to effectively represent our clients and achieve favorable outcomes. Due to our expertise, credibility, and knowledge of agency enforcement policies, Torridon lawyers are often able to convince the government not to pursue any charges. Failing that, Torridon is well positioned to help obtain a reasonable resolution that mitigates harm to the client, or, if necessary, vigorously defend the case through trial.
